Terms of Service

These terms govern your use of OneSpark. By creating an account or using the platform, you agree to them. Please read them — they are deliberately short.

Agreement to terms

OneSpark (“we”, “us”) provides a platform that turns product ideas into planned, designed, built, and tested applications (the “Service”). By accessing or using the Service you agree to be bound by these terms and by our Privacy Policy. If you use the Service on behalf of a company, you confirm you are authorized to bind that company.

Beta service

The Service is currently offered as a beta. That means, in plain terms:

  • Features may change, break, or be removed without notice.
  • Availability is not guaranteed and downtime may occur.
  • Generated results may contain errors and should be reviewed before production use.
  • Plan limits, pricing, and quotas may be adjusted as the beta evolves.

We work hard to keep the platform stable, but during the beta you use it with these caveats in mind.

Accounts

You need an account to use the Service, created through a supported sign-in provider. You are responsible for activity under your account and for keeping access to your sign-in provider secure. You must be at least 16 years old (or the minimum age of digital consent in your country) to use the Service.

Acceptable use

You agree not to use the Service to:

  • Build or distribute anything unlawful, harmful, or deceptive — including malware, phishing, or scam products.
  • Infringe the intellectual property, privacy, or other rights of others.
  • Probe, overload, disrupt, or circumvent the Service's security or usage limits.
  • Resell, scrape, or programmatically extract the Service other than through features we provide.
  • Upload content you do not have the right to use.

We may suspend or restrict accounts that violate these rules, with notice where reasonably possible.

Your content and output

You own the ideas, descriptions, and files you submit. You also own the output the Service generates for your projects — plans, documents, designs, and code — to the extent permitted by law. You grant us the license needed to host, process, and display your content for the sole purpose of operating the Service for you.

You are responsible for what you build: make sure your use of the output complies with applicable law and third-party rights.

Our intellectual property

The Service itself — the platform, its software, design, templates, and branding — belongs to us and our licensors. These terms do not grant you any right to use the OneSpark name or logo, or to copy or derive works from the platform itself.

Subscriptions and billing

Paid plans are billed in advance on a monthly or yearly cycle through our payment provider and renew automatically until cancelled. You can cancel at any time; access continues until the end of the paid period. During the beta, plan features and prices may change — we will notify you before a change affects what you pay.

Third-party services

The Service relies on third-party providers — cloud hosting, AI model providers, payment processing, and sign-in. Their availability affects ours, and their terms govern their handling of data as described in our Privacy Policy. Projects you deploy or export to third-party platforms are governed by those platforms' terms.

Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied — including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. AI-generated output is probabilistic by nature; we do not warrant its accuracy, completeness, or suitability for production without review.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, business interruption, or loss or corruption of data or content, arising from or related to your use of (or inability to use) the Service — regardless of the theory of liability and even if we were advised such damages were possible.

The Service is a beta offering provided free of charge or at introductory pricing. Accordingly, to the maximum extent permitted by law, our total aggregate liability for all claims combined is limited to the lesser of (a) the amounts you actually paid us for the Service in the three months before the first event giving rise to the claim, and (b) 50 USD. If you have paid us nothing, our aggregate liability is zero to the extent the law allows. Nothing in these terms excludes or limits liability that cannot be excluded or limited by applicable law.

You are responsible for maintaining your own copies of anything you cannot afford to lose: beta systems may suffer data loss, downtime, or breaking changes without notice, and features may be modified or discontinued at any time. Any claim must be brought within twelve months of the event giving rise to it, after which it is permanently barred to the extent the law allows.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these terms, for legal reasons, or if we discontinue the Service — with reasonable notice where possible so you can export your projects. Sections that by their nature should survive (content ownership, disclaimers, liability limits) survive termination.

Changes to these terms

We may update these terms as the Service evolves. The “Last updated” date above reflects the current version; material changes will be announced in the product or by email. Continuing to use the Service after a change means you accept the updated terms.
